Señor Director:
Entre las cartas al director del viernes 23 de marzo me ha llamado la
atención una titulada "LEY DE PROPIEDAD INTELECTUAL" en la que el Jefe de
Prensa de la SGAE, "con sorpresa y un cierto desánimo" arremete contra el
periodista M. MARTÍN FERRAND, autor de una magnífica columna publicada con
el elocuente título "La tasa del carterista" el 21/03/2007.
La leyenda urbana de Madrid, pródiga en sucesos, que evoca su autor en las
páginas de opinión de ABC AD LIBITUM, es decir, a placer y en el tiempo que
se desee, según entiendo, termina literalmente, así: "Los fabricantes de los
avanzados productos tecnológicos teóricamente susceptibles de ser grabados
con tan abusivo canon han puesto pies en pared asistidos por la razón y
avalados, ante Industria, por un millón de firmas electrónicas depositadas
en un soporte que, en lo que se plantea, devengará derechos para quienes de
ningún modo se sumarían a esta protesta. Estamos ante un despropósito que,
además de perjudicar seriamente a una industria que investiga y progresa,
fomentará la piratería, el mercado negro y, lo más importante, dañará los
intereses de los ciudadanos, que tendrán que pagar a los «autores» por
copiar las fotos de la primera comunión de sus hijos. Era más lógico,
equitativo y moral lo del carterista que cuenta la leyenda".
El señor MARTÍN FERRAND se ha quedado corto, muy corto, porque probablemente
no tenga la documentación judicial empleada por las entidades gestoras de
derechos para demandar judicialmente a particulares, con métodos que, como
criminólogo, considero inmorales y sociopáticos, pero le recomiendo que
antes de responder a la SGAE lea la sentencia de la Sala Civil del Tribunal
Supremo de fecha 5/7/2004 por la que se condenó a Jaime Peñafiel a pagar 50
millones y altísimas costas procesales, por calificar al CANON de la SGAE
como un "impuesto revolucionario", atentando contra el honor de tan
intocable persona jurídica, según la judicatura. Esa sentencia es todo un
aviso para navegantes, porque si a un periodista que no se calla ni debajo
del agua se le condena a algo así, los que estamos en contra del CANON
tenemos muy limitada nuestra capacidad de expresión. Yo soy consciente de
ello, pero también lo soy del artículo 20 de la Constitución Española cuando
opino que entre autores y editores no puede haber nada bueno cuando quien
paga sus comilonas, viajes, proyectos internacionales, sueldos escandalosos
con gastos e inversiones patrimoniales de todo tipo, son los pequeños
comerciantes y todo aquel que utiliza un CD o un DVD. Ni el comercio ni la
industria puede alimentar a ovejas y lobos, porque por muy bueno y abundante
que sea el pienso, los lobos se comerán a las ovejas si están en la misma
sede, y seguirán siendo lobos aunque se lleven muy bien con los jueces
indolentes y con los políticos débiles, les guste o no que yo les llame así.
En los últimos meses yo mismo he redactado varios dictámenes periciales para
demandados por la SGAE en juzgados de distantes provincias españolas. Puedo
asegurar, desafiando a la prueba en público si alguien lo cuestiona, que la
SGAE utiliza todo tipo de recursos, incluyendo a detectives que, en mi
opinión, provocan intencionadamente la venta de artículos sin CANON a pesar
de que el vendedor insiste en que deben de pagarlo, y en lo que a mí más me
afecta, contratan a funcionarios con dedicación completa que utilizan los
membretes y símbolos de la Universidad para impresionar a los jueces, a los
que también pretende adoctrinar mediante formación y pago de publicaciones
tendenciosas, como bien sabe el mismísimo Consejo General del Poder Judicial
(CGPJ). Las relaciones entre la SGAE y varios catedráticos de la Universidad
Politécnica de Madrid (UPM), incluyendo a su no tan magnífico Rector, son
sobrecogedoras (en el sentido de que se cogen sobres), indecentes, inmorales
e intelectualmente repugnantes, pero muy lucrativas para quienes puedan
querer demandarme por calificarlas así. Las acciones de LOBBY de la SGAE son
infinimatemente más corruptelosas que cualquiera de las que pueda haber
iniciado la industria y el comercio, pequeño o grande, porque políticos,
funcionarios y magistrados son legalmente persuadibles con buena música,
como la que muchos sábados puede escucharse en el Auditorio Nacional donde
nadie audita las prebendas y concesiones musicales como la SGAE pretende, y
frecuentemente consigue hacer, con las ventas de pequeños comerciantes.
Lástima que haya tanto dinero para alimentar a un monstruo, y tan poco para
quien pretende domarlo. Habría que civilizar un poco más a los autores más
voraces, y sobre todo, a sus editores más agresivos.

Lamento que al Jefe de Prensa de la SGAE no le gusten las opiniones de
MARTÍN FERRAND, pero a mí tampoco me gustan las suyas, bastante bien pagadas
por la SGAE, y francamente, no me importa en absoluto lo que a la SGAE
puedan parecerle las mías, a menos que también me demanden y entonces creo
que tendré el más legítimo derecho para investigar, sin límite, las
relaciones entre la SGAE y todos y cada uno de los jueces y funcionarios por
los que puedan pasar sus feroces demandas. Es algo que, con el máximo
respeto a los jueces auténticamente incorruptibles, alguien ya debería haber
empezado a hacer, sin miedo, sin descanso, y sin concesiones.

LA leyenda urbana de Madrid, ciudad pródiga en sucesos inverosímiles y
personajes estrambóticos, incluye el caso de un veterano carterista, hábil
también en las técnicas del escalo, que fue requerido por los servicios
secretos de la época franquista para una prestación «patriótica». Se trataba
de introducirse en la sede de una embajada para obtener una determinada
documentación y evitar, en la acción, el riesgo de cualquier conflicto
diplomático. El randa aceptó el encargo. «¿Cuánto quiere usted cobrar por el
trabajo?», le preguntó el funcionario encargado del caso. «Yo -afirmó el
pundonoroso delincuente- no quiero dinero por servir a España; pero me
sentiría recompensado si, durante una semana, de ocho a diez de la mañana,
se retirara toda vigilancia policial entre las estaciones de metro de Sol y
Banco de España, en la línea 2». Así se hizo, los documentos requeridos
llegaron al despacho conveniente y el carterista, una semana después, cesó
en su actividad profesional para dedicarse a la buena vida.
Lo que hoy, ya en otro tiempo, me gustaría conocer es qué tipo de servicios
le han hecho al Gobierno, y especialmente a los ministerios de Cultura e
Industria, las sociedades de gestión de derechos de autor para que puedan
reivindicar un privilegio fuera de medida sustentado en una ley de Propiedad
Intelectual votada por los partidos en la ignorancia de la realidad. El
canon sobre los CD, DVD, teléfonos multimedia, memorias fotográficas y otros
avances de la tecnología es preventivo. Por si acaso. Eso, además de
quitarle toda la certeza a la histórica relación entre uso y pago, ofende en
su dimensión cuantitativa. El canon que se perpetra prevé, por ejemplo, una
tasa de 90 euros por un iPod de 30 gigas, algo que en Alemania tiene una
tasa de 2,56 euros. Entre otras razones, para que el canon que grave la cosa
no sea más alto que el precio de la cosa. El carterista que sirvió a Franco
se conformó con una semana de recaudación como retribución a su irregular
prestación; pero los gestores de la propiedad intelectual van más lejos y
pretenden una tasa perpetua incluso por la no disposición de ningún derecho
autoral.

RESPUESTA DE LA SGAE EL 23/3/2007
Ley de Propiedad Intelectual
He leído con sorpresa y un cierto desánimo el comentario del columnista
Manuel Martín Ferrand, bajo el título «La tasa del carterista». El
comentario es un ataque directo a los partidos políticos que refrendaron
unánimemente la nueva Ley de Propiedad Intelectual, votada -según el
articulista- «en la ignorancia de la realidad». El artículo es, sobre todo,
una concatenación de insultos y agravios a las sociedades gestoras de
derechos, a las que se sitúa moralmente por debajo de los carteristas
profesionales.
Por supuesto que Martín Ferrand es muy libre de proferir descalificaciones e
insultos a su antojo. Pero como periodista debería fundamentar sus
comentarios. Y un principio periodístico es el respeto a los datos
objetivos. La columna, al margen del chascarrillo y las gravísimas
descalificaciones, sólo ofrece un dato: que las entidades gestoras reclaman
un canon de 90 euros para los iPod de 30 gigas. No sé de dónde habrá sacado
el dato el columnista, pero lo que las sociedades gestoras están solicitando
para ese dispositivo mp3 (que vale por encima de los 300 euros y que tiene
capacidad para almacenar más de 10.000 obras) es la cantidad de 4,70 euros.
Huelga el comentario ante la abismal diferencia entre el dato presentado y
el real.
El asunto del canon por la copia privada ha desatado una campaña demagógica,
a cuyo carro se han subido elementos de muy diverso signo. Lamento que un
veterano periodista como Martín Ferrand se haya sumado a ese confuso coro y
que un diario de la solvencia de ABC ofrezca su espacio a comentarios tan
viscerales y fundados en datos tan alejados de la realidad.
